Welcome to Little Sunshine Pots. Throughout the site, the terms "we", "us" and "our" refer to Little Sunshine Pots. We operate this store and website to provide you with curated garden pots, planters, and related products (the "Services"). Our store is hosted on Shopify, which provides us with the online e-commerce platform that allows us to sell our products to you.

By visiting our site or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including our Refund Policy and Privacy Policy. Please read these Terms carefully before accessing or using our website.

SECTION 1 - ELIGIBILITY AND ACCOUNT
By agreeing to these Terms, you represent that you are at least 18 years of age or have given consent for any minor dependants to use this site under your supervision. You agree to provide accurate, current, and complete purchase, payment, and contact information for all orders placed. You are responsible for maintaining the confidentiality of any account details and passwords.

SECTION 2 - PRODUCTS, MATERIAL CHARACTERISTICS & CARE
We have made every effort to display the colours, textures, and finishes of our pots and planters as accurately as possible. Because our planters are crafted from materials such as terracotta, concrete, composite, and ceramic, the following natural characteristics, visual representations, and care requirements apply:

  • Dimensions & Sizing Disclaimers: All product dimensions (height, width, diameter, and weight) listed on our website or marketing materials are approximate and provided solely as an indicative guide. Due to individual handcrafted production methods, mould variations, and material curing or kiln shrinkage, actual dimensions may vary slightly from listed specifications. Furthermore, width and diameter measurements typically refer to the external widest point of the pot, not the internal mouth or base opening. Customers are solely responsible for verifying that all dimensions (including total external footprint, height, base diameter, and internal mouth clearance) are suitable for their intended purpose, location, plant, or nursery liner. If specific dimensions are critical to your space or use, you are responsible for measuring and confirming the actual pot in person prior to departure at collection.
  • Styling Imagery & Visual Renders: Certain lifestyle and editorial images across our website and marketing are digitally styled or computer-generated (including via AI rendering) to illustrate design concepts, scale, and aesthetic inspiration in home settings. These renders are for visual guidance only and may not reflect an exact 1:1 representation of final texture, tone, or sheen. Customers are encouraged to rely on listed physical dimensions and inspect items in person during collection.
  • Natural Variation & Patina: Colour, textural irregularities, subtle indentations, and variations are natural characteristics of handmade masonry and ceramic ware. Porous materials (such as raw terracotta and concrete) naturally absorb moisture and may develop surface patina, mineral efflorescence (salt deposits), or minor discolouration from soil, fertiliser, and organic matter over time. These occurrences are expected material behaviours and are not manufacturing defects.
  • Crazing & Surface Markings: Planters may feature or develop non-structural crazing (fine micro-hairline surface lines in glazes or concrete finishes), minor surface pinholes, and subtle handling scuffs. These are natural cosmetic characteristics that do not compromise the structural integrity of the planter and are not considered defects.
  • Sealing & Drainage Care: Customers must follow recommended care practices, including ensuring drainage holes remain free-flowing and elevating planters off solid surfaces (using pot feet or packers) where necessary to prevent trapped water. Unless specifically sold as sealed for indoor surfaces, we recommend applying an appropriate pot sealer where waterproofing is desired. Little Sunshine Pots is not responsible for moisture marks, mineral staining, or water leaching onto floors, decking, or furniture.
  • Modifications Void Guarantee: Any physical modification made to the pot—including drilling additional or non-standard holes, filling or blocking drainage holes, cutting, or plumbing directly into fixed PVC/drainage pipes—immediately voids any warranty or claim of fault.
  • Plant Selection & Root Expansion: Rigid planters are susceptible to cracking if plants with vigorous, invasive, or root-bound root systems (such as aggressive ficus, bamboo, or fast-growing trees) are potted directly into them. Little Sunshine Pots is not liable for pots cracking, splitting, or failing due to internal root pressure, improper soil drainage, frost/freeze expansion, or improper planting practices.

SECTION 3 - ORDERS AND ACCEPTANCE
When you submit an order, you make an offer to purchase the selected goods. We reserve the right to accept or decline your order for any reason, including stock availability, pricing errors, or suspicion of fraud. If we cancel or modify an order, we will notify you via the email or phone number provided at checkout and promptly refund any payments processed. Purchases are intended for personal or household use and not for unauthorised commercial resale.

SECTION 4 - PRICING AND PAYMENT
All prices are displayed in Australian Dollars (AUD). Prices are subject to change without notice. The price charged will be the price displayed at the time your order is finalised. You represent and warrant that the payment details provided are valid, authorised, and that sufficient funds are available to complete the transaction.

SECTION 5 - PICKUP, STORAGE AND RISK OF LOSS

  • Local Collection: Unless delivery is explicitly arranged in writing, all orders are fulfilled via local pickup in Brisbane or at designated pop-up events. Pickup times must be scheduled in advance.
  • Collection Timeframe & Storage: Orders must be collected within 7 calendar days of notification that your items are ready for pickup, unless alternative arrangements have been confirmed in writing. Orders remaining uncollected after 7 days may be subject to a daily storage fee, or cancelled and refunded less a 20% restocking and administration fee to cover inventory holding and relisting costs.
  • Risk & Inspection: Because pottery is fragile, risk of loss, chipping, or breakage passes to you immediately upon physical collection or handover. You are encouraged to inspect your pots thoroughly upon collection.
  • Third-Party Transport: If you arrange for a courier, removalist, or third-party vehicle to collect items on your behalf, risk of damage during transport passes once the items are handed to that party.

SECTION 6 - AUSTRALIAN CONSUMER LAW GUARANTEES & LIMITATION OF COSTS
Nothing in these Terms of Service excludes, restricts, or modifies any condition, warranty, guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
Where our goods fail to meet a statutory guarantee (for example, if an item is structurally defective prior to collection or not as described), you are entitled to a remedy in accordance with your statutory rights and our Refund Policy.

To the maximum extent permitted by Australian Consumer Law, in the event of an approved claim or replacement for a defective pot, Little Sunshine Pots is responsible solely for the replacement, repair, or refund of the pot itself. We are not liable for any third-party trade costs, landscaping labour, soil disposal, or the cost of removing, re-potting, or replacing plants.

SECTION 7 - DISCLAIMER OF WARRANTIES & GENERAL LIMITATION OF LIABILITY
Subject always to Section 6 (Australian Consumer Law):

  1. The Services and products are provided on an "as is" and "as available" basis without any express warranties other than those expressly stated by us.
  2. Little Sunshine Pots and its partners shall not be liable for any indirect, incidental, punitive, or consequential loss, loss of profits, or damage arising from your use of the website or the handling, planting, or installation of products once safely handed over.
  3. To the maximum extent permitted by law, our total liability for any claim arising from a product purchased through our store is limited to replacing the goods, supplying equivalent goods, or refunding the purchase price as required by the Australian Consumer Law.

SECTION 8 - INTELLECTUAL PROPERTY
All content on this website—including images, styled product photography, digital renders, logos, copy, collection layouts, and designs—is the property of Little Sunshine Pots or our licensors and is protected by Australian copyright and intellectual property laws. You may not copy, reproduce, scrape, modify, or distribute any part of this site without our prior written consent.

SECTION 9 - INDEMNIFICATION
You agree to indemnify and hold harmless Little Sunshine Pots, its owners, partners, and service providers from any third-party claim, demand, or damages (including reasonable legal fees) arising from your breach of these Terms, misuse of our products, or violation of any law.

SECTION 10 - SEVERABILITY & ENTIRE AGREEMENT
If any provision of these Terms is deemed unlawful or unenforceable by a court of competent jurisdiction, that provision will be severed, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Little Sunshine Pots.

SECTION 11 - GOVERNING LAW
These Terms of Service and any purchases made through our store are governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland.
